Welcome to XpertEdu.in ("Platform", "Website", "Service"), an AI-powered learning companion. This Platform is developed and maintained by Patodia Infotech Private Limited (the "Company", "We", "Us", "Our") and marketed by Akshaya Edutech LLP.

These Terms and Conditions ("Terms") constitute a legally binding agreement governing your access to and use of the services offered on the Platform. By accessing, browsing, registering, or using our Platform, you ("User", "You", "Your") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Definitions

• "Platform" refers to the website Xpertedu.in, including all its sub-domains, pages, services, and AI-powered tools.
• "AI-Generated Content" means any text, code, explanations, or other data generated by the artificial intelligence models on the Platform in response to a User's query.
• "User Content" refers to any query, data, or information you submit to the Platform.

2. Eligibility and Account Registration

1. Eligibility: To use our Platform, you must be at least 18 years of age and competent to enter into a contract under the Indian Contract Act, 1872. If you are a minor (under 18 years), you may use the Platform only under the supervision and with the consent of a parent or legal guardian.
2. Account Responsibility: You are responsible for creating and maintaining the confidentiality of your account credentials (username and password). You agree to provide accurate, current, and complete information during the registration process.
3. Account Security: You must notify us immediately of any unauthorized use of your account. We shall not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. Use of Services and User Conduct

1. Permitted Use: The services and AI-Generated Content are provided for your personal, non-commercial, and educational purposes only.
2. Prohibited Conduct: You agree not to use the Platform to:
   • Engage in any form of academic dishonesty, including but not limited to plagiarism, cheating, or submitting AI-Generated Content as your own original work without proper attribution or permission.
   • Upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, infringing, or otherwise objectionable under applicable laws in India.
   • Attempt to gain unauthorized access to our systems, scrape data, reverse-engineer, or disrupt the integrity or performance of the Platform.
   • Use the Platform for any commercial purpose or for the benefit of any third party without our prior written consent.
   • Violate any applicable local, state, national, or international law, including the Information Technology Act, 2000 and its subsequent rules.

4. Intellectual Property Rights

1. Our Ownership: The Platform, its design, logos, trademarks, and all underlying software and technology are the exclusive property of Patodia Infotech Private Limited and its licensors.
2. License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its AI-Generated Content strictly in accordance with these Terms.
3. AI-Generated Content: While you may use the AI-Generated Content for your educational needs, you do not acquire any ownership rights over it. The redistribution, sale, or creation of derivative works from this content is strictly prohibited.
4. User Content: By submitting User Content (your queries), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and adapt such content for the purpose of operating, improving, and developing our services.

5. Disclaimers and Limitation of Liability

1. No Guarantee of Accuracy: The AI-Generated Content is provided for informational and educational purposes only. We do not warrant the accuracy, completeness, or reliability of this content. It may contain errors or omissions. Users must independently verify all critical information.
2. "As-Is" Service: The Platform is provided on an "as-is" and "as-available" basis without any warranties of any kind, express or implied.
3. No Guarantee of Academic Outcomes: Use of our Platform does not guarantee any specific academic result, grade, or success.
4. Limitation of Liability: To the fullest extent permitted by law, in no event shall Patodia Infotech Private Limited, Akshaya Edutech LLP, their directors, designated partners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Platform or your reliance on any AI-Generated Content. Our total aggregate liability in any matter arising out of or related to these terms is limited to the greater of ₹5000 or the total amount paid by you to us in the six (6) months preceding the event giving rise to the liability.

6. Privacy Policy

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.

7. Termination

We reserve the right to suspend or terminate your account and access to the Platform, at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.
